That page has nothing to do with the horn gun in your truck bed. Here is what the federal rule actually regulates, what a quiet zone is, and which laws really decide whether you can fire a 150 dB battery horn gun.

The short answer

The FRA Train Horn Rule, published at 49 CFR Part 222, governs one thing: the horn mounted on a locomotive as it approaches a public highway-rail grade crossing. Its scope section applies it to locomotives and the railroads that operate them. It says nothing about aftermarket horns, pickup trucks, boats, UTVs, or handheld air horns.

A quiet zone is a stretch of track where the railroad has been excused from routinely sounding that locomotive horn because the local government installed extra crossing safety hardware. It is not a noise-free district, it does not ban vehicle horns, and it does not create a new law that applies to you. What the Train Horn Rule actually says

The rule took effect on June 24, 2005, after FRA published the final version in the Federal Register on April 27, 2005. It spells out exactly how a locomotive engineer must use the horn at a public crossing:

  • Timing. The horn must begin sounding at least 15 seconds, and no more than 20 seconds, before the lead locomotive enters the crossing. If the engineer cannot judge the arrival time precisely, a good-faith start of up to 25 seconds is allowed.
  • Distance cap. A train running faster than 60 mph may not begin sounding the horn more than one-quarter mile, or 1,320 feet, before the nearest public crossing.
  • Pattern. Two long blasts, one short, one long, repeated or prolonged until the locomotive occupies the crossing.
  • Loudness. Under the companion rule at 49 CFR 229.129, each lead locomotive horn must produce between 96 dB(A) and 110 dB(A) measured 100 feet forward of the locomotive and 15 feet above the rail.

Those numbers are a federal spec for a locomotive horn sounded at a fixed point for a fixed reason. The rule contains no decibel limit for a car horn, a truck horn, or a handheld horn, because it never contemplates them.

What a quiet zone is (and is not)

The same rule lets a "public authority," meaning the city, county, or agency responsible for traffic control at the crossing, establish a quiet zone. Inside it, engineers stop routinely sounding the horn at each crossing. To qualify, the zone has to meet minimums written into 49 CFR 222.35 and Appendix A of the rule:

  • The zone must be at least one-half mile long along the track and every public crossing in it must have flashing lights and gates.
  • Each highway approach gets an advance sign warning drivers that train horns are not sounded there.
  • The added risk from the missing horn has to be offset with supplementary safety measures: four-quadrant gates, gates with medians or channelizers extending at least 100 feet from the gate arm (60 feet where an intersection is close), one-way streets with gates, or closing the crossing outright.
  • Establishing one is a paperwork process, not a federal permit. The public authority mails a Notice of Intent, waits out a 60-day comment window for the railroad and state agencies, then mails a Notice of Establishment that takes effect no sooner than 21 days later. FRA is notified, but it does not have to approve a zone built on approved safety measures.

The National League of Cities reported in April 2025 that an FRA official counted 1,016 quiet zones nationwide covering more than 5,500 grade crossings, up from roughly 700 five years earlier. So there is a decent chance a quiet zone runs through or near your town. Even inside one, the rule at 49 CFR 222.23 lets an engineer sound the horn in an emergency, when crossing gates fail, or when a person, animal, or vehicle is on the tracks. A quiet zone silences routine horn use, not the horn itself.

Some communities instead install a wayside horn: a stationary horn at the crossing that fires toward the road when a train approaches. Under 49 CFR 222.59 a wayside horn can replace the locomotive horn at any crossing with lights and gates, inside or outside a quiet zone, and once it is running the railroad must stop routine horn use there.

Why the rule exists: Florida's whistle ban

The whole framework grew out of a state experiment. On July 1, 1984, Florida let local governments ban train horns between 10 PM and 6 AM at gated crossings on in-state railroads. FRA studied the Florida East Coast Railway's 511 affected crossings from 1984 to 1989 and found the nighttime collision rate rose 195 percent after the bans, while daytime collisions at the same crossings stayed flat. FRA issued an emergency order in 1991 ending the Florida bans, and a follow-up 1995 nationwide study found that crossings with horn bans averaged 84 percent more collisions than similar crossings without them.

Congress responded with the Swift Rail Development Act of 1994, which added 49 U.S.C. 20153 and directed the Secretary of Transportation to require locomotive horns at public crossings while allowing exemptions where safety measures make up for the missing warning. Why buyers mix up the two "train horn" rules

The confusion is vocabulary. "Train horn" means both the horn on a locomotive and the aftermarket category of loud vehicle and handheld horns that copy its tone, so a truck owner searching "is my train horn legal" lands on a rule about railroads. This table sorts out which rulebook governs what.

The "audible 200 feet" and "unreasonably loud or harsh" language comes from the Uniform Vehicle Code template most states adopted. Texas Transportation Code 547.501 is a typical example: it requires a horn audible at least 200 feet, prohibits a sound that is unreasonably loud or harsh, and bars whistles and sirens on non-emergency vehicles. What does apply to your horn gun

Strip out the FRA rule and three layers are left. First, the state vehicle code, which governs horns on vehicles used on public roads. Most states require a working horn, cap it with "unreasonably loud or harsh" language rather than a decibel number, and limit use to safety. Second, local noise ordinances, which apply anywhere in town, road or not, and usually turn on time of day and distance. Third, for commercial trucks, the Federal Motor Carrier Safety Regulations at 49 CFR 393.81 require an "adequate and reliable" horn on every bus, truck, and truck-tractor, but set no upper limit.
